Section 232 Aluminum Filing Extensions Cease After May 10

CUSTOMS BORDER PROTECTION TO CEASE SECTION 232 ALUMINUM FILING EXTENSIONS

Customs Border Protections (CBP) announced the end of Section 232 Aluminum Filing Requirements extensions after May 10, 2023 during a recent National Customs Brokers & Forwarders Association of America webinar. CBP officials indicated that the Agency does not “anticipate additional extensions” despite the possibility that filing software will not be ready for the May 10 filing requirements deadline.

CBP also revealed plans for a 3-phase Section 232 Aluminum Filing deployment that addresses:

  • Phase 1 – implementation for collecting five new entry summary elements, including country origins for smelt and cast aluminum;
  • Phase 2 – mass processing enhancements; and a
  • Phase 3 – a focus on the internal user interface.

During the call, CBP officials explained that tariffs will become due prior to the date data requirements take effect. Importers will begin paying 200% duty on April 10, 2023 in accordance with the Chapter 99 tariff schedule number even though Importers are not yet required to indicate country origin for smelt and cast aluminum on their entry summaries. However, CBP stated that the 200% tariff does not apply on aluminum with Russian content that is not of Russian origin when the originating country charges its own 200% tariff on aluminum from Russia.
