USTR Asks if Section 301 Tariffs Should Continue as Four-Year Review Approaches

As the four-year anniversary of Section 301 tariffs on goods from China approaches, the Office of the U.S. Trade Representative (USTR) is asking domestic industry and stakeholders if the penalties should continue or be terminated.

Under Section 301 of the Trade Act of 1974, the USTR’s investigation of China’s Acts, Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation resulted in additional duties on specific product lists that were modified and provided exclusions over time.  These trade actions went into effect on July 6, 2018, and August 23, 2018.

FOUR-YEAR REVIEW PROCESS

The USTR review will happen in two phases; the first allows domestic industries that benefit from the trade restrictions a 60-day window to comment on whether or not Section 301 tariffs should continue or be allowed to terminate.  If the industry requests Section 301 penalties to continue, the USTR will publish the second phase of the review process detailing the next steps for industry input.
