WHAT IS THE SECTION 232 AUTO PARTS INCLUSION PROCESS?

The Department of Commerce’s interim final rule establishing the Section 232 automobile parts inclusion process took effect September 17, 2025, creating a formal pathway to add automobile parts to the tariff list under Proclamation 10908. Administration of this process falls to the International Trade Administration (ITA), which will accept and review requests from U.S. producers and industry associations. ITA must complete its review and issue a determination within 60 days of receiving a valid request, giving importers and manufacturers a clear timeline for potential tariff changes.

WHEN SHOULD COMPANIES FILE AUTOMOBILE PARTS INCLUSION REQUESTS?

Two-week filing windows open four times per year in January, April, July, and October. The first official window opens October 1, 2025. Requests must be submitted in PDF format to [email protected] and must include the relevant HTSUS codes, import and production data, and an explanation of how imports threaten to impair U.S. national security, all within a 30-page limit.

WHAT IS THE REVIEW PROCESS?

ITA will confirm that submissions meet all requirements, post non-confidential versions for a 14-day public comment period, and begin its review immediately. Commerce must approve or deny each request within 60 days and will publish decisions in the Federal Register. Approved automobile parts will be added to the tariff list at the eight- or ten-digit HTSUS level, with duties taking effect the day after publication.

HOW SHOULD IMPORTERS PREPARE FOR THE OCTOBER 1 SUBMISSION WINDOW?

Importers and OEMs should:

  • Review HTSUS classifications for potential exposure.
  • Monitor Regulations.gov for posted requests.
  • Prepare sourcing and pricing plans for affected parts.
  • Coordinate with customs brokers to apply duties promptly once they take effect.
