Mattress Imports Under Antidumping and Countervailing Duty Investigation

The U.S. Department of Commerce (DOC) has officially initiated both antidumping (AD) and countervailing duty (CVD) investigations to determine if mattresses imported from the following countries are being sold below fair market value or receiving unfair domestic subsidies:

  1. Cambodia
  2. Indonesia
  3. Malaysia
  4. Serbia
  5. Thailand
  6. Turkey
  7. Vietnam
  8. China

Under the antidumping investigation, the DOC will evaluate whether mattresses from Cambodia, Indonesia, Malaysia, Serbia, Thailand, Turkey, and Vietnam are being sold at less than fair market value.  Petitioners allege mattresses from these countries have dramatic dumping margins, such as:

  • Cambodia: 326.497 – 675.83%
  • Indonesia: 213.44 – 429.74%
  • Malaysia: 42.92%
  • Serbia: 57.37 – 183.16%
  • Thailand: 414.77 – 763.28%
  • Turkey: 267.55 – 609.51%
  • Vietnam: 481.72 – 989.90%

For the purpose of AD investigations, dumping occurs when a foreign company sells a product in the United States at less than its fair value. For the purpose of CVD investigations, a countervailable subsidy is financial assistance from a foreign government that benefits the production of goods from foreign companies and is limited to specific enterprises or industries or is contingent either upon export performance or upon the use of domestic goods over imported goods.

Under the countervailing duty investigation, the DOC will evaluate if producers of mattresses in China are benefiting from unfair government subsidies such as loan programs, export credits, tax breaks and grants.

If the U.S. International Trade Commission (ITC) determines that dumped or unfairly subsidized mattress imports have created material injury to U.S. industry,  the DOC will be able to impose duties equivalent to the damage that has occurred.
