US Targets EU in New Section 301 Tariffs for Aerospace, Product List Published

On Monday, April 8, 2019, the Office of the U.S. Trade Representative announced that it will begin yet another round of Section 301 retaliatory tariffs, this time, aimed at an ongoing dispute with the European Union (EU) and the subsidization of Airbus, one of the two leading providers of aerospace manufacturing.  Since 2004, the United States has been at odds with the EU (specifically France, Germany, Spain, and the United Kingdom), and in 2011, the World Trade Organization (WTO) confirmed that the EU was providing Airbus with $18 billion in subsidized financing from 1968 to 2006.  The aid was instrumental in helping the aerospace company to launch all models of its large civil aircrafts, and caused their U.S. competition, Boeing, to lose sales on over 300 aircraft as well as overall market share.

In May 2018, a final appellate report found that EU subsidies to high-value, twin-aisle aircraft did indeed cause serious prejudice to U.S. interests; but these WTO findings have had little impact on EU actions.  While removing some minor subsidies, the EU went on to grant Airbus an additional $5 billion in aid for their newest A350 XWB model and filed their own counter claims against United States’ subsidization of competitor, Boeing.  On Thursday, March 28, 2019, the WTO ruled in favor of the EU’s claim against the U.S., but only found one subsidy worth only $100 million per year paid to Boeing from 2013 to 2015.

“This case has been in litigation for 14 years, and the time has come for action. The Administration is preparing to respond immediately when the WTO issues its finding on the value of U.S. countermeasures,” said U.S. Trade Representative Robert Lighthizer. “Our ultimate goal is to reach an agreement with the EU to end all WTO-inconsistent subsidies to large civil aircraft.  When the EU ends these harmful subsidies, the additional U.S. duties imposed in response can be lifted.”

Currently, the United States and European Union are in WTO arbitration, reviewing valuation claims; but that isn’t stopping the USTR from making their own progress.  USTR has released a preliminary list of EU products to be covered by additional duties for public comment, valued at $11 billion in trade annually.

Targeted products have been released in two lists: Section 1 for products specifically from France, Germany, Spain and the United Kingdom and Section 2 covering products from any of the twenty-eight member States of the European Union.
