Section 301 Update: New Exclusions & HTS Additions

The Office of the U.S. Trade Representative (USTR) released another round of exclusion updates for Lists 1 and 3, while importers of Chinese manufactured goods hurried to make final submissions for List 4a tariff exclusion requests under Section 301.

USTR NOTICE: List 3 New Exclusions

Exclusions apply retroactively to Sept. 24, 2018, and will remain in effect until Aug. 7, 2020.

0304.83.5015 – Alaskan sole (yellowfin, rock or flathead), frozen in blocks, in cases with net weight of more than 4.5 kg.

USTR NOTICE: List 1 New Exclusions

The exclusions apply retroactively to July 6, 2018 and expire on October 2, 2020.

  1. Effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on July 6, 2018, and before October 2, 2020, U.S. note 20(x) to subchapter III of chapter 99 of the Harmonized Tariff Schedule of the United States (HTSUS) is modified by inserting the following exclusions in numerical order after exclusion (93):

(94) 8413.70.2004 – Centrifugal pumps, submersible, designed for use in artificial lift systems for extracting oil and gas.

(95) 8413.91.9060 – Pistons and housings for hydraulic fluid power pumps of the type used in power lawn mowers.
