CBP Expands Successful Section 321 Pilot Program, Invites Additional Participants

U.S. Customs and Border Protection (CBP) released a Federal Register Notice inviting additional participants to their Section 321 Data Pilot. The Pilot enables CBP to collaborate with private sector supply chain parties to identify and target at-risk shipments for inspection with the goal of swiftly clearing legal packages.

SECTION 321 DATA PILOT PROGRAM

A public-private partnership, the Section 321 Data Pilot helps mitigate risk while expediting lawful
e-commerce freight valued at $800 or less to enter the U.S. tax and duty-free.

According to CBP, 85% of packages that enter the U.S. are low-value e-commerce shipments. The program has created more accurate risk assessment and adjudication for CBP with fewer CBP holds for private shippers.

The Section 321 Data Pilot was first launched in August 2019 to test the benefit of accepting advanced data from e-commerce supply chain partners, including voluntary pilot participants Amazon, eBay, and Zulily among others.

CBP has processed more than 380 million shipments via the Section 321 Data Pilot since it was initiated in August 2019. Section 321 Data Pilot information has enabled faster and more accurate risk assessment by CBP and fewer holds for the pilot participants who are submitting additional data elements, such as seller information, product pictures, and other details. CBP is excited to expand the pilot, as bringing on board additional partners will allow the agency to test new technologies and the collection of non-traditional data elements to identify additional facilitation benefits for the trade community and CBP.”
