The U.S. Department of Commerce has established a new process that allows certain steel and aluminum producers to qualify for adjusted Section 232 tariff treatment. The framework links tariff reductions to verified commitments to expand U.S. production capacity, introducing a formal application and compliance structure.
WHO QUALIFIES FOR SECTION 232 STEEL AND ALUMINUM TARIFF ADJUSTMENTS UNDER THIS PROCESS?
Eligibility is limited to steel and aluminum producers operating in Canada or Mexico that supply U.S. manufacturers, either directly or through parts. Only projects that expand U.S. primary steel or aluminum production capacity tied to automotive and related sectors are considered.
Qualifying imports must meet United States Mexico Canada Agreement origin requirements and specific melt and pour or smelt and cast criteria.
HOW ARE TARIFF ADJUSTMENTS APPLIED?
Approved applicants may receive reduced Section 232 tariffs on qualifying imports, with rates not falling below 25 percent. The adjustment applies only to import volumes that correspond to newly committed U.S. production capacity and is limited to a defined time period.
HOW DOES COMPLIANCE IMPACT TARIFF ELIGIBILITY?
Applicants must submit detailed project documentation, including production plans, capacity increases, supplier and construction details, and defined project milestones. Submissions must be certified by a senior executive and include a commitment to quarterly reporting. Approved companies must report progress and import activity on a quarterly basis. If project milestones are not met, tariff adjustments may be suspended or revoked, and prior entries may be subject to full duty assessment.
