CBP EXTENDS ENTRY DEADLINE FOR IEEPA RECIPROCAL TARIFF IN-TRANSIT EXEMPTIONS

U.S. Customs and Border Protection (CBP) extended the entry deadline for goods eligible under the in-transit exception to IEEPA Reciprocal Tariffs. The extension applies to shipments loaded prior to the April 5, 9, or 10 effective dates and entered on or before June 15, 2025. This temporary measure remains in place while the Federal Circuit Court’s stay of judgment remains in effect.

ENTRY DEADLINE EXTENDED TO JUNE 15, 2025

CBP updated its position on when in-transit claims remain realistic. Previously, CBP stated that entries had to be filed before May 28, 2025, to qualify. With this revision, entries filed by 11:59 p.m. EDT on June 15 may still claim exemption status, provided all other in-transit conditions are met.

APPLICABLE IEEPA TARIFF HEADINGS

HTSUS 9903.01.28 is appropriate for merchandise of any origin that:

  • Was loaded prior to April 5, 2025
  • Remained on board the final mode of transport to the U.S.
  • Entered or withdrew for consumption between April 5 and June 15, 2025

HTSUS 9903.01.25 applies to shipments that meet the following criteria. Note, that they are also subject to a 10% additional rate of duty in lieu of any country-specific rate:

  • Were loaded and in transit between April 5–8 (general reciprocal actions), or
  • Between April 9–9 (China-specific window)
  • Entered or withdrew for consumption before June 16, 2025
NEXT STEPS FOR U.S. IMPORTERS OF IEEPA-IMPACTED GOODS

Importers should confirm transit dates and entry timing now. CBP will not permit in-transit claims for shipments entered on or after June 16, 2025. This update does not impact Section 301, 232, or MFN rates.
