CBP Updates Requirements on Aluminum Entry Data for Recycled Products

UPDATE: On March 30, 2023, Customs Border Protections (CBP) announced plans to delay new entry summary requirements to report countries of smelt and cast for imports of aluminum and aluminum derivates by 30 days allowing, “time for the trade to update their software programming and systems to comply with these new reporting requirements.” The delayed requirements take effect on May 10, 2023. “There is no change to the April 10, 2023 effective date of the 200 percent duties on imports of aluminum and derivative aluminum articles that are products of Russia, or where any amount of primary aluminum used in the manufacture of such aluminum articles is smelted in Russia, or where such aluminum articles are cast in Russia.”

On February 24, 2023, Presidential Proclamation 10522 on the Adjustment of Aluminum Imports to the United States was issued to identify the countries where primary aluminum used in the manufacture of imports of aluminum articles and derived aluminum articles are smelted.

ALUMINUM ENTRY DATA REQUIREMENTS

Customs Border Protection (CBP) updated the guide with the entry requirements for aluminum and aluminum-derived products from all countries of origin. The new version stipulates that if the recycled aluminum contains only secondary aluminum, declarants may report ‘N/A’ for the country of primary and secondary smelting.

WHAT IS SECONDARY ALUMINUM?

Secondary aluminum is the aluminum metal that is produced from aluminum scrap obtained by a re-melting process.

Under Chapter 99 of the Harmonized Tariff Schedule of the United States (USHTS), the following aluminum articles and derivatives are covered by the smelting and casting reporting requirements:

Aluminum articles: unwrought aluminum, bars, rods and profiles, wire, plates, sheets, strips, foil, tubes, pipes and tube or pipe fittings, castings, and forgings of aluminum.

Aluminum derivatives articles: stranded wire, cables, plaited bands, and the like, including slings and similar articles, of aluminum and with steel core, not electrically insulated; the foregoing fitted with fittings or made up into articles; the foregoing comprising electrical conductors, not fitted with fittings or made up into articles; bumper stampings of aluminum, the foregoing comprising parts and accessories of the motor vehicles; body stampings of aluminum, for tractors suitable for agricultural use.

WHEN ARE THESE CHANGES EFFECTIVE?

Effective May 10, 2023, declarants of aluminum products must include the primary and secondary country of smelting and the country of cast for CBP to perform the tariffs proper administration on Russian aluminum that also applies to third-country aluminum products containing Russian aluminum.
