FMC REJECTS EXPEDITED EMERGENCY SURCHARGES AS CARRIERS ADJUST TO MIDDLE EAST DISRUPTIONS

Ocean carriers are introducing emergency fuel and conflict-related surcharges as vessels reroute around the Middle East. These adjustments are increasing fuel consumption, transit times, and insurance exposure across Asia to North America trade lanes.

WHY DID THE FMC REJECT IMMEDIATE IMPLEMENTATION?

Carriers requested approval to implement some surcharges without the standard 30-day notice period. The Commission rejected those requests as surcharges must be filed and implemented in accordance with tariff requirements under the Shipping Act, including standard notice timelines. Under 46 CFR 520.8, tariff increases must be filed 30 days in advance unless carriers can demonstrate good cause under 46 CFR 520.14. The Commission determined that while costs had increased, carriers did not provide sufficient detail linking those costs to the proposed surcharge amounts or duration.

WHEN DO THESE SURCHARGES TAKE EFFECT?

With waiver requests denied, implementation follows standard timelines. For filings submitted in early March, this places effective dates in early April. Most emergency fuel surcharges are aligned to April gate-in dates, making cargo timing a key factor in whether charges apply. Tariff rules require that the surcharge be in effect at the time cargo is received.

Refrigerated cargo continues to carry higher surcharge levels due to operating sensitivity and equipment requirements.
