Section 301: Exclusions, Extensions, and Expirations

On December 31, 2019, the Office of the United States Trade Representative (USTR) issued the final set of Section 301 product exclusions for the 2019 calendar.  The exclusions, reflected in 2 ten-digit HTSUS subheadings and 66 specially prepared product descriptions, covering 81 separate exclusion requests.


LIST 3 ($200 BILLION): EXCLUSIONS GRANTED DECEMBER 31, 2019

65) 9403.20.0090 – Wheeled trays, each with 5 wheels, 3 bowls of plastic with suction cup bottoms and adjustable height from 65 cm to 108 cm

66) 9403.90.6005 – Baby crib liners, each composed of two pieces of multi-layer warp polyester knit mesh without any padding, one measuring no more than 29 cm by 283 cm and the other measuring no more than 29 cm by 210 cm

67) 9405.40.8440 – Flexible strips having embedded light-emitting diodes electrically connected to a molded electrical end connector, each strip wound onto a reel measuring not more than 25 cm in diameter and not more than 1.5 cm in width

68) 9405.40.8440 – Light boxes, each measuring not more than 32 cm by 58 cm by 12 cm, weighing less than 10 kg, with two biaxial fluorescent lamps that provide light therapy for seasonal and sleep disorders.


LIST 1 ($34 BILLION): NOTICE OF EXTENSIONS FOR EXCLUSIONS EXPIRING DECEMBER 28, 2019

Earlier in the month, the USTR also approved one-year extensions for 6 of the 31 exclusions that were set to expire on December 28, 2019.

One-year extensions will remain in effect until December 28, 2020 for:

  1. 8418.69.0120 – Radio transceivers, citizens band (cb) type
  2. 8525.60.1010 – Drinking water coolers, refrigerated, self-contained
  3. 8420.10.9080 – Roller machines with dies for embossing paper, manually powered
  4. 8481.90.9040 – Angle cock handle assemblies, of iron and steel, each measuring 11.43 cm by 21.59 cm by 5.08 cm and weighing 0.748 kg
  5. 9022.14.0000 – Radiation therapy systems, each encased by steel-based structural shell with gantry cover comprising three pairs of plastics-based panels
  6. 9032.10.0030 – Thermostats designed for air conditioning or heating systems, not designed to connect to the internet, the foregoing designed for wall mounting

The following exclusions were not granted and have expired since December 28, 2019:

  2. 8480.71.8045 – Injection type molds for rubber or plastics, others
