ANTIDUMPING DUTY ORDERS TARGET MATTRESS IMPORTS FROM MULTIPLE COUNTRIES

The Department of Commerce (DOC) and the International Trade Commission (ITC) recently made joint affirmative determinations, leading to the issuance of antidumping duty orders on mattresses from originating from Cambodia, Indonesia, Malaysia, Serbia, Thailand, Turkey, and Vietnam. Additionally, the DOC amended its final determination on mattresses from Cambodia.

UNDERSTANDING THE SCOPE

The new orders apply to a broad range of mattresses, including both “adult mattresses” and “youth mattresses.” “Adult mattresses” includes various sizes like twin, extra-long twin, full, queen, king, and California king, while “youth mattresses” typically refer to crib, toddler, or youth-sizes. All adult and youth mattresses fall within the scope, regardless of their size descriptions.

Various mattress types, categorized as “innerspring mattresses,” “non-innerspring mattresses,” and “hybrid mattresses” are also included in the orders. Innerspring mattresses feature interconnected metal springs that correspond to mattress dimensions, and hybrid mattresses combine multiple support systems like layers of memory foam and innerspring units. In contrast, “non-innerspring mattresses” are usually made from materials such as polyurethane foam, memory foam, latex foam, gel-infused viscoelastic foam, thermobonded polyester, polyethylene, or other resilient fillings.

EXCEPTIONS

While these orders encompass a wide array of mattresses, some are excluded, including:

“Futon” mattresses, airbeds (including inflatable mattresses) and waterbeds, which rely on air or liquid-filled bladders as their primary support systems.

Multifunctional furniture that transitions from seating to sleeping, featuring upholstered filler materials within the furniture framing and an outermost layer that converts into a sleeping surface is exempt. This type of furniture is often known as “convertible sofas,” “sofabeds,” “sofa chaise sleepers,” “futons,” “ottoman sleepers.”

Products covered by existing antidumping duty orders on uncovered innerspring units from China or Vietnam.

Bassinet pads with specific dimensions, including a nominal length of less than 39 inches, a nominal width less than 25 inches, and a nominal depth of less than 2 inches.

“Mattress toppers,” removable bedding accessories that supplement a mattress by providing an additional layer on top, with a height of four inches or less.

Companies importing mattresses from Cambodia, Indonesia, Malaysia, Serbia, Thailand, Turkey, or Vietnam will need to assess the impact on their operations.
